Detention Review

The Canada Border Services Agency (CBSA) has the authority to detain a permanent resident or a foreign national if the Immigration Division office is not satisfied with the identity documents or a person is dangerous to the public and a flight risk.

If the person is detained, within 48 hours of the detention or as soon as possible, the Immigration Division will review the reasons for detention.

 

Upon review, the Immigration Division may decide to release the person or order the person to continue to be detained.

 

The continued detention will be completed within 7 days. A detention review may also be prescribed within 30 days.
